David is Counsel to McLaughlinQuinn and practices in the firm’s Tax Planning and Tax Resolution practice groups. David concentrates his practice on the overlap of tax and estate planning issues, and frequently includes the integration of special needs planning with traditional estate plans. He assists clients with selecting the appropriate estate plans for their families and financial circumstances.

David also counsels individuals and businesses on a wide variety of tax matters. David has assisted many clients with resolving controversies with the IRS and the Massachusetts Department of Revenue. Prior to law school, David worked as a Tax Examiner for the IRS. Prior to joining McLaughlinQuinn, David served as chair of the tax practice of a large Massachusetts law firm.

David has presented publicly on a number of estate planning and tax issues, on topics ranging from planning for special needs in multigenerational estate plans to minimizing the imposition of estate taxes. He has also presented at educational seminars for accountants and attorneys.

Representative Matters:

  • Works with clients and their advisors to establish the estate plans appropriate for the clients’ circumstances
  • Has significant experience in drafting special needs trusts and integrating them into clients’ estate plans
  • Has significant experience in using qualified personal residence trusts, charitable remainder trusts, private foundations, and other sophisticated planning techniques
  • Serves as professional trustee for a number of clients
  • Represents clients in IRS estate tax audits, including the successful contest of a proposed estate tax assessment in excess of $1 million
  • Represents clients in IRS gift tax audits, including the successful contest of a proposed gift tax assessment in excess of $400,000
  • Represents clients in income and excise audits, including the successful settlement of a Massachusetts Appellate Tax Board case that resulted in the client’s meals tax assessment being reduced by over $100,000
  • Assists many clients in connection with the reduction or elimination of tax penalties
  • Represents clients in connection with the formation and operation of non-profit entities
